Patryk Jaki: The ECJ Wants to Subjugate Poland to European Elites

The European Court of Justice (ECJ) has issued a statement that should shake up public debate in Poland. It declared—contrary to EU treaties—that the Polish Constitution cannot be in conflict with EU law, and it labeled the rulings of Poland’s Constitutional Tribunal on this matter as “rebellion.”

This was the main topic of discussion in an interview with MEP Patryk Jaki from the European Conservatives and Reformists (ECR) group on the program W Punkt, hosted by Katarzyna Gójska. Jaki did not mince words, accusing the European Union of applying double standards to Poland.

Attack on the Polish Tribunal or a New Legal Order?

According to Patryk Jaki, the EU is attempting to subjugate Poland by weakening its institutions and stripping it of key competencies.

“Poles gave their lives to ensure that German or Prussian law would not stand above the laws made by Polish citizens. Today, the fight for sovereignty continues, but instead of military tools, legal and financial mechanisms are being used. A pro-German government is being installed in Poland, and the supremacy of EU law over the Constitution is being forced upon us,” Jaki stated.

He emphasized that the EU treaties do not explicitly establish the primacy of EU law over national law.

“Article 5 of the EU treaties clearly states that the Union can only act within the competencies delegated to it by member states. We have never transferred the right to subordinate our Constitution to EU law,” he added.

Double Standards Toward Poland

The PiS MEP pointed out that similar rulings by constitutional courts in other countries have not provoked such a strong reaction from the ECJ.

“What is considered a defense of sovereignty in Germany, France, the Czech Republic, or Spain is labeled as ‘rebellion’ in Poland. Poles are treated as second-class citizens who are not allowed to apply the same legal solutions as Germans or the French,” he said.

Dispute Over Elections and “Neo-Judges”

Jaki also addressed concerns about Poland’s judicial system, warning about potential challenges to the legitimacy of future presidential elections. He pointed to statements from government officials that, in his view, suggest an attempt to undermine election results.

He argued that the EU and Donald Tusk’s government are pushing the concept of “neo-judges” as a way to arbitrarily treat Poland as a country with an inferior legal culture.

“The Venice Commission claims that some countries can apply certain legal systems, but Poland cannot—allegedly because we have a lower legal culture. Meanwhile, it was Poles who created the first constitution in Europe and were pioneers in building democracy,” he stated.

It’s About Poland

Jaki’s remarks highlight the critical moment Poland is facing. Decisions are being made that will determine the country’s future, while, according to him, those in power are serving foreign interests. If Poles do not wake up, he warns, the country could become entirely subordinated to European institutions. The decisive battle will take place at the ballot box in May.

“This isn’t just about elections, laws, or judges. This is about whether Poland will remain a nation where its citizens make decisions or whether it will become a region governed by EU bureaucrats. This is the moment for Poles to wake up and say: we will not surrender our sovereignty without a fight,” the MEP declared.
