President Nawrocki’s Decisive Move as Lawyers Scrutinize the CJEU Ruling on the Constitutional Tribunal

Lawyers from the President’s Chancellery are analyzing the judgment of the Court of Justice of the European Union (CJEU) concerning the Constitutional Tribunal. A firm and official response from Karol Nawrocki will follow in the near future. He will oppose violations of the constitutional order of the Republic of Poland, high-ranking officials at the Presidential Palace told the portal Niezależna.pl.

At today’s hearing, the Court of Justice of the European Union ruled that the Polish Constitutional Tribunal, by failing to respect the case law of the CJEU, violated several fundamental principles of EU law. Moreover, the judgment assessed that the Constitutional Tribunal does not meet the requirements of an independent and impartial court established by law.

The Constitutional Tribunal responded to the ruling in a statement, indicating that the decision expressed by the CJEU “was issued entirely outside the competences of that body.”

It was also recalled that “the supreme law in the Republic of Poland is the Constitution, not decisions of foreign bodies.” It was added that Poland did not relinquish the primacy of national law over EU law when it acceded to the European Union in 2004.

The President’s move

A firm, official response from President Karol Nawrocki will be issued in the near future, most likely at the beginning of next week. This is due to the head of state’s tight schedule. On Thursday, he is meeting with the NATO Secretary General, and on Friday with the President of Ukraine.

“There will be a very decisive response from the President in a short time. The lawyers at the President’s Chancellery are currently analyzing the CJEU ruling. The President will not agree to such violations of the law. He is the guardian of the Polish Constitution. The Constitution defines the system of the Republic and is the supreme law, not the judgments of EU tribunals,”

one of the President’s closest associates told Niezależna.pl.
