    Revisiting the Ewa Tylman Case: Appellate Court Reverses Adam Z.’s Acquittal

    The Appellate Court in Poznań has overturned the acquittal verdict of Adam Z., accused of the murder of Ewa Tylman, and referred the case for reconsideration by the court of first instance. This decision means that the Poznań District Court will handle the case for the third time.

    Ewa Tylman went missing in November 2015; her body was found in the Warta River after several months. Due to the significant decomposition of the body, experts were unable to determine the cause of death conclusively. According to the prosecution, on November 23, 2015, Adam Z. pushed Ewa Tylman off a slope and then threw her unconscious into the water. The prosecution charged him with murder with conceivable intent, carrying a penalty of up to 25 years in prison or life imprisonment.

    The trial of Adam Z. took place before the Poznań District Court from January 2017. In April 2019, the District Court ruled that Adam Z. did not kill Ewa Tylman and acquitted him of the charge of murder with eventual intent. In January 2020, the Appellate Court in Poznań overturned the verdict of the first-instance court and referred the case for reconsideration.

    The retrial of Adam Z. began in March 2021. In the closing statement, the prosecution requested a guilty verdict for Adam Z. and a sentence of 15 years in prison, as well as the payment of restitution to the Fund for the Aid of Victims and Post-Penitentiary Assistance. The defense, on the other hand, sought the acquittal of the accused. The proxies of the auxiliary prosecutor, meanwhile, called for the acknowledgment of the defendant’s guilt.

    In May 2022, the Poznań District Court acquitted Adam Z. of the charge of murdering Ewa Tylman. Following this non-binding verdict, the prosecution filed an appeal, challenging the entire decision and requesting its annulment and the referral of the case for reconsideration.

    On Tuesday, the Appellate Court in Poznań heard the case. After deliberation, the court issued a ruling overturning the district court’s verdict and referring the case for reconsideration by the court of first instance.

    This means that the trial of Adam Z., accused of the murder of Ewa Tylman, will proceed before the Poznań District Court for the third time.
