We will fight for rescission of penalties – this is what the Deputy Foreign Minister said about the sanctions imposed by the CJEU judge. Paweł Jabłoński points out that this is a situation that has not occurred before. The government intends to fight “for its own” through the course of law.
Jabłoński was asked in an interview on Radio Wnet on Monday whether the road to bilateral talks on the issue is already closed. “We would like to talk, but we have the impression that the Czech side has simply decided not to do so at the moment,” the Deputy Minister assessed.
In his view, the negotiations so far have shown that “there is no readiness to conclude a real agreement and implement it before the elections (in the Czech Republic)”.
“What the election will be – it’s hard to predict,” he added.
At the same time, the Deputy Minister stressed that the situation that has occurred is “absolutely unprecedented”.
“Until now, nothing like this has ever happened in the Court’s jurisprudence. We’re going to fight for rescission of CJEU penalties,” he announced.
When asked how to force the CJEU to take up the matter in full, Jablonski replied:
“Here we will properly present our legal argument through the proper legal remedies available to us. “I would not like to tell you more about this today, whereas the process is ongoing. (…),” he said.
At the end of September, after two days of talks in Prague, Polish negotiators announced that Polish and Czech delegations failed to agree on the content of the agreement on the KWB Turów, which would later be accepted by both governments. Earlier, the Czech side informed that working out such an agreement would make it possible to withdraw from the CJEU the complaint against Poland concerning the operation of the Turów mine.
