The court will once again deal with the provocation on Chłodna Street – an action by the communist secret police, in connection with which criminal proceedings were initiated in the courts of the Polish People’s Republic against Fr. Jerzy Popiełuszko. The case was discontinued in 2019 by the District Court in Warsaw, and in 2020 – this decision was upheld.
The Supreme Court revoked the decision to discontinue due to the statute of limitations of criminal proceedings against those accused of the so-called provocation in Chłodna Street, that is the tossing by Security Service (SB – Służba Bezpieczeństwa) to the apartment of Fr. Jerzy Popiełuszko fictional documents incriminating the clergyman in 1983. This issue is to be dealt with once again by the Court of Appeal in Warsaw.
The case concerned the tossing to the clergyman’s apartment in 1983 by the Security Service of documents incriminating him, including ammunition, explosives, as well as leaflets and publications, the possession of which was then prohibited. Due to these actions by the SB, criminal proceedings against the chaplain of Solidarity were instituted.
