A company from Sanok has filed a lawsuit with a Warsaw court. It has a specific demand directed at Tusk

A company from Sanok submitted a lawsuit to a Warsaw court, demanding that the head of government, Donald Tusk, be ordered to announce in the Journal of Laws (Dziennik Ustaw) a ruling of the Constitutional Tribunal (TK) that concerns the company. The case was reported by Dziennik Gazeta Prawna (DGP).

According to the newspaper, the lawsuit was filed with the District Court for Warsaw-Śródmieście. “Its author demands that the court establish the prime minister’s obligation to issue a statement with the following content: ‘The Prime Minister orders and instructs the President of the Government Legislation Centre to publish in the Journal of Laws the ruling of the Constitutional Tribunal of 7 August 2025, SK 55/22, on the day following the receipt of this statement’“, the daily reported.

“This lawsuit is the result of disagreement with the helplessness in the face of a dispute between constitutional state bodies, which harms the economic interests of the entrepreneur,” explained attorney Grzegorz Rysz, the author of the lawsuit, quoted by DGP.

As DGP reports, he is the legal representative of the company from Sanok, on whose behalf he filed the lawsuit in the Warsaw court. He had previously represented the firm in proceedings before the TK, which ended with a ruling declaring unconstitutional the provisions under which his client was required to pay a concession fee, despite no longer engaging in the activity covered by the concession.

“We waited almost four years for the tribunal’s ruling, since we filed the complaint in December 2021,” the attorney noted. In March 2024, the parliamentary majority adopted a resolution stating that “the consideration of TK rulings issued in violation of the law in the activities of public authorities may be regarded as a breach of the principle of legality by those authorities.” Since the adoption of that resolution, TK rulings have not been published in the Journal of Laws.
