A Murderer Without Supervision. Authorities Plan to Fit Cyba with an Electronic Bracelet. The Court Will Decide in May

Proceedings are currently underway at the Regional Court in Łódź concerning the imposition of an electronic monitoring bracelet on the convicted murderer Ryszard Cyba, in order to track his whereabouts, according to findings by the portal Niezalezna.pl. At present, the perpetrator is under no supervision whatsoever. “Formally, at this moment, the sentence against him is not being enforced. There are no grounds for anyone to be supervising him, whether in a social welfare home or a psychiatric hospital,” stated Judge Grzegorz Gała, spokesperson for the Łódź court.

TV Republika revealed that Ryszard Cyba—the murderer of Law and Justice (PiS) activist Marek Rosiak—was released from prison following a decision by Judge Monika Gradowska of the Regional Court in Łódź to “suspend enforcement proceedings.” Cyba was initially to be transferred to a social welfare home or a homeless shelter; however, after displaying aggressive behaviour, he was placed in a psychiatric hospital ward.

We inquired about Cyba’s case with the spokesperson of the Regional Court in Łódź, Judge Grzegorz Gała, with whom we had already spoken earlier in the day. During a follow-up conversation, the issue of Cyba’s supervision emerged, which—as was acknowledged during a press conference held by deputy ministers of justice—is currently not being conducted by either police officers or Prison Service officials.

“Formally, at this moment, the sentence against him is not being enforced. There are no legal grounds for anyone to be supervising him, whether in a social welfare institution or psychiatric hospital,”

the judge emphasized.

“Since March 18, the Regional Court in Łódź has been conducting proceedings to determine whether Mr Cyba may be fitted with an electronic monitoring bracelet in order to monitor his location. A hearing on this matter has been scheduled for May 8. The court will issue a decision once it receives another expert opinion on whether or not such a bracelet should be applied,”

the court’s spokesperson told Niezalezna.pl.

“We are supervising him in the sense that we need to know where he is and in what condition,”

stated Judge Gała.

What Is Electronic Monitoring?

Electronic monitoring is a method of supervising the behaviour of a convicted individual using technological means. According to the applicable legal provisions, the electronic monitoring system may be used to control:

  • The presence of the convicted person at a location designated by the court or penitentiary commission during specified days and hours (stationary monitoring);
  • The current whereabouts of the convicted person, regardless of location (mobile monitoring);
  • The maintenance of a court-specified minimum distance from a particular individual (proximity monitoring).

The imposition of an electronic monitoring bracelet may serve to prevent a convicted individual, who is outside of a correctional facility, from fleeing or evading law enforcement authorities.
