Is a prosecutorial trap being prepared for Dr. Emil Jędrzejewski? Although prosecutors insist that the questions asked on Wednesday did not concern medical confidentiality, the former head of department’s silence and his request for the presence of legal counsel were fully justified. The prosecutor’s office has not ruled out bringing charges against the physician over what he said during an interview on Kanał Zero. Meanwhile, the questioning of Dawid Kacprzyk may be delayed by more than a month.
The questions put to Dr. Emil Jędrzejewski by prosecutors on Wednesday concerned mainly his employment, the contract he signed with Warsaw Southern Hospital, administrative and financial matters, and the management of the facility.
This was confirmed by Piotr Antoni Skiba, spokesperson for the Warsaw District Prosecutor’s Office. He stressed that the questions directed at Dr. Jędrzejewski did not concern matters covered by medical confidentiality and “did not concern the practice of medicine in the context of medical consultations and treatment.”
A Trap for the Doctor
Really? “If medical confidentiality had been at issue, the doctor should have invoked it rather than remain silent,” Skiba said when questioned by TV Republika.
That is precisely why Dr. Jędrzejewski’s decision to refuse to answer the questions and to demand that any testimony be given in the presence of legal counsel was justified. The questioning is expected to take place on Monday.
Legal representation is all the more necessary because a “trap” appears to have been prepared for the physician. If, while testifying before prosecutors, he invokes medical confidentiality, he could be charged with breaching it over what he said during his interview on Kanał Zero, under Article 266 §1 of the Polish Criminal Code. When asked about this by TV Republika, Skiba did not deny the possibility.
Jędrzejewski is expected to be questioned, among other things, about how and when he informed Warsaw Mayor Rafał Trzaskowski of irregularities at the hospital. The former head of the surgery department at Warsaw Southern Hospital informed the hospital’s management board and supervisory board in June 2025 about alleged irregularities involving Dawid Kacprzyk, then coordinator of the hospital’s Emergency Department. In July, he also informed Warsaw Mayor Rafał Trzaskowski. Trzaskowski confirmed this during Thursday’s session of the Warsaw City Council. However, the complaint was not accepted by the hospital because it lacked the signatures of members of the medical staff and physicians.
No Rush to Question Kacprzyk
What about the questioning of Dawid Kacprzyk? As TV Republika reported earlier this week, prosecutors intend to summon him – based on the current state of the evidence – as a witness. However, this is expected to take place only after other witnesses have testified, including Warsaw city officials and individuals responsible for managing the hospital. Realistically, the questioning is unlikely to take place for at least another month, and possibly even two.
The prosecutor’s office was expected to receive a statement from Kacprzyk on Thursday in which he declares his current whereabouts, provides his contact details, and expresses his willingness to appear when summoned.
