The judge, appointed by the communist State Council, has replaced Judge Dariusz Łubowski as head of the International Proceedings Section of the Regional Court in Warsaw. “The repression that has affected Judge Dariusz Łubowski is unprecedented in the history of the Polish judiciary,” comments attorney Adam Gomoła.
Sixty-nine-year-old Judge Tomasz Grochowicz, who replaced Judge Dariusz Łubowski as head of the International Proceedings Section in criminal law matters at the Regional Court in Warsaw, was appointed in 1987 by the communist State Council, as established today by the Niezalezna.pl portal.
“It would be hard to find a better symbol of the rule of Tusk and Żurek in the judiciary,” wrote former Deputy Minister of Justice Michał Woś. “Life writes the most interesting scenarios,” he added.

The case of Judge Dariusz Łubowski has caused significant upheaval within the legal community.

When, overnight, an experienced judge, who apparently no longer suited the current political authorities, is removed and replaced with someone ‘trusted’ and, as may be inferred, regarded as reliable, the question arises: is this about competence or loyalty? If the key to promotion within the courts is whether someone is favored by those in power, we begin to approach standards more commonly associated with countries beyond our eastern border, where judicial independence is a slogan rather than a principle. And that is truly alarming,”

“It fits into the disgusting hypocrisy of those who, until recently, protested with mouths full of slogans in the ‘defense of the rule of law.’ If you have suffered so many wrongs, if you lit candles in defense of judicial independence, why are you silent now, when, because of a single ruling, issued not to your liking, your recent colleague is being publicly and shamelessly trampled like a social outcast?”
