“There were no reasons to make this swap and point to a specific person who, as one must assume, will agree to sign an order whose content was decided not in a court but in politicians’ offices,” said Marcin Romanowski, a Law and Justice (PiS) MP on TV Republika. The politician commented in this way on the order concerning the removal of Judge Dariusz Łubowski issued by Judge Magdalena Wójcik.
In December 2025, the Warsaw Regional Court overturned the European Arrest Warrant issued against Marcin Romanowski as part of the investigation into the Justice Fund.
In response, Justice Minister Waldemar Żurek announced that the application for the warrant would be refiled and that he would seek the exclusion of Judge Dariusz Łubowski, who in the ruling overturning the EAW described the actions of the governing coalition as a “crypto-dictatorship”.
Judge Łubowski was indeed removed from the case. As attorney Bartosz Lewandowski indicated, when considering the prosecutor’s application for an EAW against Romanowski, the random assignment of a judge was abandoned. Although the duty judge was initially to handle the case in line with the schedule of the Warsaw Regional Court, unexpected changes were suddenly introduced. The decision in this matter was made by Judge Magdalena Wójcik, Chair of the 8th Criminal Division at the Warsaw Regional Court. MP Romanowski commented on Judge Wójcik’s actions on TV Republika.
“Thanks to this information, the circle of those responsible for abuse of power and rigging judicial panels is becoming clearer. There is no doubt that we are dealing here with something organized. Judge Wójcik issued an order under which no random draw took place, but instead the judge who ultimately received the case was indicated,” he said.
He recalled that “duty schedules are often set more than a month in advance, and here, from one day to the next, a judge was swapped by a decision of Chair Magdalena Wójcik”.
“This is blatant tampering, manipulation of judicial panels. Attorney Lewandowski established that the judge who was originally on the schedule is not on leave and is adjudicating normally today. There were no reasons to make this swap and point to a specific person who, as one must assume, will agree to sign an order whose content was decided not in a court but in politicians’ offices,” he assessed.
In his opinion, “Lady Justice has long ceased to be blind”.
“We see that she has picked up a baseball bat and is beating over the head those who expect justice,” he concluded.
