A resident of Nadarzyn, who placed a banner criticizing Donald Tusk on his property fence, has been accused by the police of “promoting Nazism, communism, fascism, or other totalitarian systems.” The prosecutor’s office has already launched an investigation. It took the police two weeks to respond to our inquiries about the case. “To me, the police’s actions are a blatant violation of freedom of speech and an attempt to intimidate people who want to express their political views,” says MEP Tobiasz Bocheński (PiS) in an interview with niezalezna.pl. He also declared legal support for the man harassed by law enforcement.
Criticizing Tusk Is Not Allowed
On April 29, Telewizja Republika aired an interview with Kazimierz Litke, a resident of Nadarzyn near Warsaw, who hung a banner on his fence depicting the so-called “Line of Tusk’s Betrayal.” The content criticized a defense plan from 2011, revealed on September 17, 2023, by former Defense Minister Mariusz Błaszczak, which was approved by Bogdan Klich, the defense minister in the PO-PSL government. The declassified document stated that in the event of Russian aggression, nearly half of Poland’s territory would fall under Russian occupation within two weeks, with a potential defense line along the Vistula River.
Police officers from the Nadarzyn station removed the banner from the fence, securing it as evidence in an ongoing investigation. They then interrogated Mr. Kazimierz as a suspect.
The resident of Nadarzyn decided to put up another banner with the same message, but this time, instead of Donald Tusk’s image, it featured a rectangle with the word “Censorship.”
Troublesome Questions
Niezalezna.pl contacted the press office of the Pruszków County Police Headquarters for clarification. The portal inquired what illegal content was on the banner, who filed the complaint, on what legal basis the police intervened, and whether the homeowner is under investigation—and if so, on what charges.
The email proved “problematic” for the press office—despite multiple follow-ups (5 phone calls and 5 text messages), a response came only after two weeks.
Shocking Allegations
Deputy Inspector Monika Orlik confirmed that on April 25, Nadarzyn police received a report of a crime. All actions were taken under Article 308 of the Code of Criminal Procedure, related to Article 256 § 2 of the Penal Code (promoting totalitarian ideologies). The case was forwarded to the Pruszków District Prosecutor’s Office, which initiated an investigation on May 9.
Violation of Freedom of Speech
