Five Hours Without a Breathalyzer Test: Disturbing Failures in the Police Handling of the Piaseczno Rape Case

An officer suspected of raping a policewoman in Piaseczno was tested for alcohol only five hours after the incident, according to investigative materials. Nearly 12 hours passed between the incident and his arrest. During that time, the suspect remained… in the same unit and was “under supervision” by officers who were directly responsible for what was happening at the scene.

“I decided to speak out because I can no longer listen to how you PiS hyenas behave. You are hyenas. You are engaging in disgusting political games on the suffering of this woman. In this case, the reaction of the Polish police was immediate,” said Minister of the Interior and Administration Marcin Kierwiński on Thursday in the Sejm, addressing PiS MPs.

The case concerns the rape of a young policewoman, which occurred in early January on the premises of the Warsaw Police Prevention Unit in Piaseczno. The suspect is her superior.

We examined the speed and effectiveness of this response—and doubts emerged.

Chronology and doubts

  • The incident—the rape of a young policewoman and forcing her to submit to another sexual act—was to have occurred on Saturday, January 3, at approximately 3:30 a.m.
  • At 8:15 a.m., the first examination of the suspect took place. It turned out that he was still under the influence of alcohol. Two further tests followed later. Why did it take as long as five hours?
  • At 10:35 a.m., the formal acceptance of the victim’s report began. The interview lasted until 12:00 p.m.
  • The formal arrest took place at 2:45 p.m. and was carried out by officers of the Internal Affairs Bureau of the Police from Warsaw, on the premises of the unit in Piaseczno. Until the Internal Affairs Bureau took over, the suspect was—as the prosecutor’s spokesperson put it in an interview with us—“under the supervision of the command of the Warsaw Police Prevention Unit.”

Here another doubt arises. For 12 hours, the perpetrator was under the questionable “supervision” of individuals who were directly responsible for the fact that such a scandalous incident occurred in that very unit. They could therefore have had an interest in potentially covering up the case.

Today, the police announced that “the deputy commander of the Police Prevention Unit in Warsaw was dismissed from his post on January 7, in connection with the suspicion that a subordinate officer committed a crime, over whose company he exercised official supervision.”

Let us go further. Procedural activities involving the suspect began at the District Prosecutor’s Office in Piaseczno on January 4 at 1:30 p.m. The detention hearing began on January 5 at 11:00 a.m. at the District Court in Piaseczno. The decision to apply pre-trial detention was issued between 1:00 p.m. and 2:00 p.m. on the same day.
