Head of National Security Bureau under prosecutorial review following ABW notification

The District Prosecutor’s Office in Lublin has decided to examine a notification submitted by the Internal Security Agency (ABW) concerning an alleged “abuse of authority by officials.” The matter relates to the fact that in February this year, Prof. Sławomir Cenckiewicz, head of the National Security Bureau (BBN), participated in a meeting of the National Security Council.

The spokesperson for the Lublin prosecutor’s office, Marek Zych, announced on Monday that a notification from the ABW had been forwarded to the 8th Military Affairs Division of the District Prosecutor’s Office in Lublin. The notification concerns “the exceeding of powers by identified officials in connection with allowing a person without security clearance to access classified materials.”

Prosecutors from the military division, Zych added, will carry out “a substantive and legal assessment of the circumstances related to the notification of a suspected crime.”

The case is linked to a meeting of the National Security Council convened by President Karol Nawrocki on February 11 this year, which concerned, among other things, a loan from the SAFE program. In addition to the head of state, the meeting was attended by Prime Minister Donald Tusk, the Speakers of the Sejm and the Senate, as well as representatives of the Presidential Chancellery and the National Security Bureau, including its head, Sławomir Cenckiewicz. It is worth recalling that, despite a court ruling favorable to the head of the BBN, politicians from the ruling camp claim that he does not have access to classified information.

Prof. Cenckiewicz has access to classified information

In July 2024, the Military Counterintelligence Service (SKW), led by Jarosław Stróżyk, attempted to revoke Prof. Cenckiewicz’s security clearance. The professor appealed this decision. The case was ultimately resolved by the Voivodeship Administrative Court in Warsaw, which, on June 17, 2025, overturned the decisions of both the SKW and Prime Minister Donald Tusk in this matter. In its extensive justification, the court stated that “there had been a violation of substantive law” and that there were no grounds to conclude that Prof. Cenckiewicz did not guarantee the protection of classified information.

The case has been appealed to the Supreme Administrative Court (NSA), while representatives of Tusk’s government act as though the ruling of the Voivodeship Administrative Court is not binding with regard to Prof. Sławomir Cenckiewicz’s access to classified information.
