“Żurek’s people organized a sweep to find judges to replace Judge Dariusz Łubowski,” reported TV Republika. The broadcaster showed a document issued by the Vice President of the Sąd Okręgowy w Warszawie, addressed to the heads of the criminal divisions. Judge Łubowski was removed from adjudicating after he revoked a European Arrest Warrant against Marcin Romanowski.
TV Republika presented the letter that the Vice President of the Warsaw District Court, Judge Aneta Obszyńska‑Małocha, sent to the heads of the court’s criminal divisions.
Below is the content of the message:
“Dear Division Chairs,
In connection with the need to provide adjudicatory support to the Section for International Proceedings in criminal matters arising from international relations within the VIII Criminal Division of the District Court in Warsaw, I kindly request information as to whether judges in the divisions under your supervision would express interest in and consent to a change in their current allocation of duties and an additional assignment to adjudicate in the above-mentioned Section. In every case, whether there is no interest in an additional assignment or whether judges do express such interest, I kindly ask that you provide a response by 22 January 2026 at 2:00 p.m.”

Let us recall: in December 2025, the Warsaw District Court revoked a European Arrest Warrant against Marcin Romanowski issued in the investigation into the activities of the Justice Fund.
In response, the Minister of Justice, Waldemar Żurek, announced that he would submit a renewed application for the warrant and would seek the recusal of Judge Dariusz Łubowski, who, in the ruling annulling the EAW, described the actions of the governing coalition as a “crypto-dictatorship.”
The judge in question was indeed removed. Moreover, as reported by attorney Bartosz Lewandowski, in the proceedings concerning the prosecutor’s application for the issuance of an EAW for Romanowski, the random assignment of a judge was abandoned. When the case was to be handled by the duty judge, sudden changes occurred in the Warsaw District Court’s schedule.
