Judge Who Sentenced Pensioner Over Owsiak Also Dismissed Case Involving Assault on Police Officer

Former head of the Ministry of the Interior and Administration, Mariusz Kamiński, sharply criticized the court rulings issued by Judge Marcin Czarciński, contrasting the sentence imposed on an ailing pensioner for an online comment about Jerzy Owsiak with the dismissal of a case involving violence against a police officer. “Does Tusk’s sour rye soup taste good to you?” he asked.

Toruń Court Sentences 67-Year-Old Pensioner for Online Comment About Jerzy Owsiak

The District Court in Toruń yesterday announced its verdict in the case of Ms. Izabela, a 67-year-old pensioner accused of making threats against Jerzy Owsiak. The woman was sentenced to six months’ imprisonment, suspended for one year, and ordered to pay 1,000 PLN to the head of Wielka Orkiestra Świątecznej Pomocy. The court fully upheld the prosecution’s motion.

“Die, man” – this comment posted online about Jerzy Owsiak became the basis for criminal proceedings against the 67-year-old resident of Toruń. The post was classified by the prosecution as a criminal threat and public incitement to commit a crime. In January 2025, the woman was detained in her apartment by the police. Among those involved in the operation were the deputy city police commander and the head of the criminal department.

Toruń Court Conditionally Discontinues Case After Assault on Police Officer, Citing Low Social Harm

As Kamiński points out, in another case, handled by the same judge, the court conditionally discontinued criminal proceedings against a person who, during a police intervention, beat and bit an officer, deeming the act to be of low social harm.

The incident occurred in March last year in Toruń. Police were called to a premises where night-time disturbance was reported, and the notifications suggested that violent behavior might be taking place. Even before entering, officers could hear noise. Inside, they found a ransacked interior, scattered and broken items, and a door torn off its hinges in one of the rooms.

Those present at the scene questioned the legitimacy of the intervention. The atmosphere quickly escalated. After a brief scuffle, a woman began directing vulgar and insulting words at the officers. The police used handcuffs and called for backup. During the intervention, one officer was bitten, kicked, head-butted, and spat on.

The case went to the District Court in Toruń. Judge Marcin Czarciński ruled that both the guilt and the social harm of the act were not significant, and that the circumstances of its commission raised no doubts. The proceedings were conditionally discontinued for a two-year probation period, with the accused obliged to refrain from alcohol abuse.
