Justice Fund Paralyzed Under Żurek. “This Is a Criminal Failure to Perform Duties”

The Justice Fund is once again making headlines. This time, however, not in a context convenient for the December 13 Coalition – under the pretext of holding political predecessors to account. “Suspending funding for support to victims of violence is not only a moral low point. It is also the crime of failure to perform duties (Article 231 § 2 of the Criminal Code) and a violation of public finance discipline,” writes Marcin Warchoł, a member of Law and Justice (PiS) and former Minister of Justice, on X.

Over the past few days, alarming reports concerning the Justice Fund have emerged. According to media findings, the Ministry of Justice, under the leadership of Waldemar Żurek, failed to conclude the competition process in time. As a result, victims of crimes will not receive support.

Further reports indicate that the ministry hired an additional ten officials to assess formal applications and contracted an external company from Warsaw to conduct the substantive evaluation of applications. The cost – PLN 1 million.

What is particularly striking is that this company approached Ms Karolina – who spent several months in pre-trial detention at the request of the prosecutor’s office in connection with the investigation into the Justice Fund – with a job offer involving… the substantive assessment of applications under the FS.

This is a crime

The chaos surrounding the Fund and the actions of the leadership of the Ministry of Justice are being widely commented on in the public sphere. It is also possible that further revelations will come to light – either indicating deliberate actions or demonstrating a complete lack of competence among those at the helm of the ministry.

Yesterday, former Deputy Minister of Justice Michał Woś presented on x.com the state of the FS for 2026.

“PLN 898 MILLION, including – PLN 487 million in the account – PLN 252 million in uncollected (!) adjudicated receivables. And from January 1, victims of crimes will be left without support – the network of 300 centers built by Zbigniew Ziobro and Marcin Romanowski will cease to operate,” he wrote.

This information was addressed by Marcin Warchoł, former Minister of Justice and MP from Law and Justice (PiS). As he pointed out, “suspending funding for support to victims of violence is not only a moral low point.”

“It is also the crime of failure to perform duties (Article 231 § 2 of the Criminal Code) and a violation of public finance discipline. The Justice Fund is statutorily obliged to spend the funds accumulated in its account. It is a special-purpose fund subject to the Public Finance Act, which clearly states that funds must be spent in accordance with the financial plan. If the plan is not implemented on time, unspent funds from a special-purpose fund must be returned (ruling of the Main Adjudication Commission for Violations of Public Finance Discipline, BDF1.4800.56.2024, Warsaw, 4 August 2025),” we read further.

The politician also reminds that “the Supreme Administrative Court likewise orders unspent funds to be returned to the State Treasury budget – meaning that if you do not spend them for the intended purpose, you cannot keep them (judgment of 9 January 2014, II GSK 1540/12).”
