Revenge for ‘crypto-dictatorship’? Judge Łubowski Removed from the Romanowski Case

The Warsaw Regional Court has removed Judge Dariusz Łubowski from examining a renewed request to issue a European Arrest Warrant against Law and Justice (PiS) MP Marcin Romanowski, the court’s spokesperson, Judge Anna Ptaszek, announced. “The announcement made by Minister Waldemar Żurek has materialized,” attorney Bartosz Lewandowski wrote on X.

In December last year, the Warsaw Regional Court revoked the European Arrest Warrant against Marcin Romanowski that had been issued as part of an investigation into the activities of the Justice Fund.

At the time, attorney Bartosz Lewandowski said that the court had shared his view that the investigation into Romanowski involved “unlawful political pressure, and the actions of law enforcement authorities pose a threat to rights and freedoms protected by the constitution and international law.” In the written justification, Judge Dariusz Łubowski described the actions of the December 13 Coalition as a ‘crypto-dictatorship‘.

Romanowski’s European Arrest Warrant. Judge Łubowski Will Not Hear the Case

This triggered an angry reaction from those in power. As early as the second half of December, Waldemar Żurek assured that a renewed motion would be filed to apply an European Arrest Warrant against Romanowski. Żurek also stated that the prosecution would seek to have the judge who revoked the European Arrest Warrant against Romanowski excluded from rehearing the case. This is exactly what happened, and it is now clear that Judge Dariusz Łubowski will not hear the case.

“The motion to exclude Judge Łubowski from examining the renewed request to issue an ENA in the case of Marcin Romanowski has been granted,” the SO’s press spokesperson said.

She added that this is a decision against which no appeal may be lodged. As Judge Ptaszek explained, the renewed European Arrest Warrant request against Romanowski will now “be referred for random assignment, and a new judge will be drawn.”

Attorney Lewandowski voiced an unequivocally critical assessment:

Judge Dariusz Łubowski, who revoked European Arrest Warrant against Romanowski and criticized the actions of the services and the Public Prosecutor’s Office, and who also identified political pressure on judges in the investigation concerning the Justice Fund, has been excluded and removed from adjudicating. Thus, the announcement by Minister Żurek has materialized. The renewed request to issue an European Arrest Warrant against Romanowski will be heard by another judge,” he wrote on X.

Rhetorical questions were raised by Supreme Court Judge Kamil Zaradkiewicz:

“Judge Łubowski is allegedly biased and lacking impartiality because he does not rule in line with regime functionaries? Does anyone still find such pseudo-legal acrobatics surprising?” he asked.
