Romanowski: From Rule of Law to “Third World” Standards – A Gangster State in the Making

Themis will stop being blind – it will be the prosecutor who decides which judge convenient to him will issue decisions. This is blatant lawlessness, completely contrary to any standards of civilized states. This is exactly where Żurek, Tusk, and this entire gang of gangsters place themselves, said Law and Justice (PiS) MP Marcin Romanowski on the air of TV Republika.

The District Court in Warsaw overturned the European Arrest Warrant (ENA) issued against Marcin Romanowski.

In the reasoning, Judge Dariusz Łubowski shared the view that had been voiced from the very beginning by those opposed to the current authorities during the “accountability” process of the former deputy justice minister – namely, that political pressure had been exerted throughout the case.

This is an unlawful proceeding, as it violates the most fundamental human rights of all accused persons, namely the presumption of innocence. These are actions that devastate the image of the Polish justice system domestically and, what is most important in this case, also internationally, reads a fragment of the reasoning. Judge Łubowski also emphasized that the situation currently prevailing in the Polish State can be classified as a cryptodictatorship.

When the reasoning appeared in the public sphere, the judge quickly became the target of political attacks from supporters of the December 13 coalition. Moreover, the justice minister himself – Waldemar Żurek – announced that the ENA application would be resubmitted and criticized the judge’s decision in the Romanowski case.

What is more, Żurek threatened that if the application were to return to Judge Łubowski, the prosecution would seek to have him excluded from the case. Why? Because the decision was not objective. Or rather – not to the liking of those in power.

Romanowski: A Gang of Gangsters

MP Romanowski has repeatedly referred both to the content of the court’s ruling and to Waldemar Żurek’s numerous announcements in this matter – announcements of further lawlessness.

Today, on the air of TV Republika, he spoke with the station’s president, editor Tomasz Sakiewicz. Asked about the announcement that the judge would be excluded if the prosecutor’s application returned to him, he replied: This is, of course, a scandalous action, a scandalous statement. And it confirms those theses, assessments, or legal qualifications that Judge Łubowski included in the reasoning of his ruling. If a representative of the executive branch announces that he will exclude a judge because of the content of a ruling and will choose one who issues the ruling he desires, then this is already Belarus, Russia, or the Third World.

After all, let me remind you that this Interpol decision from April placed Poland on the level of Russia or Belarus. And perhaps we talk too little about it. I would also draw attention to Żurek’s statement – right at the beginning after the ruling was issued. He complains that the judge did not notify the prosecution of what ruling he would issue. That is what his complaint boils down to. How can one say such things? They no longer even hide their crude attitude that courts are to issue decisions at the behest of the executive branch. According to Romanowski, what they are doing is the destruction of the state and open governmental criminality – against the state, and official criminality.

I think that any lawless state is not capable of controlling the entire reality 100 percent. It is capable of controlling the most important political matters for it. And it succeeded quite strongly – for a long time. However, there occurred such an incident as a courageous and independent judge – Judge Łubowski, he continued.

In his assessment, the accumulation of such events, when we look at recent months, always brings a breath of hope. However, I think that this authority is primarily wearing itself out. If we talk about the state of the judiciary, then there may be several hundred judges who issue decisions under political diktat.

“Complete Lawlessness”

Earlier that same day, Romanowski wrote on x.com that the actions of the government consisting in interference by ‘the highest-ranking representatives of the executive branch in the sphere of judicial independence’ were classified in a final court ruling as a phenomenon ‘unseen in any civilized legal order.’

The court further stated: “Facts notoriously known to the Polish, and unfortunately also the international, public opinion are cases of drastic violations of the constitutional order by the executive authority in Poland.

“Tusk’s gang has brought Poland to a state of complete lawlessness and the demolition of the rule of law, for which it must bear political, economic, and criminal responsibility. This responsibility cannot be avoided by all those guilty of criminal political persecutions connected with attacks on the Justice Fund – regardless of whether they wear white collars or prosecutorial and judicial robes. Justice must be enforced with full determination so that these people never again harm anyone or destroy the Polish State,” read the further part of the MP’s post.
