Shocking Court Ruling: Civic Coalition MP Roman Giertych Awarded 35,000 PLN for Unlawful Detention by the CBA

Roman Giertych, a member of parliament from the Civic Coalition, will receive 35,000 PLN in compensation for his detention that took place several years ago. The case concerns actions carried out by the Central Anti-Corruption Bureau (CBA) in connection with an investigation into the company Polnord.

Giertych was detained in October 2020 in connection with an investigation into causing harm to Polnord and misappropriating assets valued at over 72 million PLN. During the CBA’s proceedings with him, he suddenly fainted. He claimed that the charges had not been properly presented, as he was unconscious at the time. He later left for Italy for an extended period, returning only after winning a parliamentary seat in the 2023 elections.

In January 2021, the District Court Poznań-Stare Miasto ruled that the decision to detain Giertych and search his home was “unjustified.” The court determined that the CBA was not the proper authority to conduct those actions. Following that ruling, Giertych pursued legal action.

In the first instance, the court awarded the lawyer 20,000 PLN in compensation. However, the Court of Appeal in Warsaw later amended the decision, increasing the amount to 35,000 PLN. The ruling was issued on October 15.

“I will demand that this money be collected from the prosecutors who ordered the detention,” declared the politician.

The investigation dropped

The proceedings against Giertych were discontinued in January 2025. The daily Gazeta Polska Codziennie had already reported in November 2024 that such a decision was expected.

According to GPC, at the end of October 2024, a document signed by Prosecutor Marek Wełna, Director of the Department for Economic Crime at the National Prosecutor’s Office, was sent to Lublin. The document reportedly suggested discontinuing the investigation against Giertych, as the evidence was weak and any potential indictment “would not stand up in court.”
