State Tribunal session on Prof. Manowska’s immunity. Date confirmed

At the beginning of September, a plenary session of the State Tribunal (TS) will be held to consider motions submitted by the illegally seized National Prosecutor’s Office (PK) to lift the immunity of TS chairperson Małgorzata Manowska. The date was announced by TS judge and President of the Polish Bar Council (NRA), Przemysław Rosati.

On July 22, five judges of the State Tribunal requested the convening of a plenary session to discuss the prosecutor’s motion to lift the immunity of TS chairperson Małgorzata Manowska. This was in response to a request by the illegally seized National Prosecutor’s Office to adopt resolutions authorizing the criminal prosecution of the First President of the Supreme Court, Prof. Małgorzata Manowska.

The charges include, among others, the alleged failure to convene a State Tribunal session, despite the judges’ request reportedly not even meeting the formal criteria.

The case also involves votes held in the Supreme Court College – some judges were present at the meeting but did not cast votes, which – in line with previous practice – was treated as an abstention.

A third allegation concerns the failure to comply with a final ruling by the District Court in Olsztyn, which ordered the removal of a resolution issued by the Disciplinary Chamber from the Supreme Court’s case law database – a move that would have been in breach of the law.

Date confirmed

President of the Polish Bar Council, Przemysław Rosati, announced on Sunday the date of the TS session regarding the lifting of Manowska’s immunity. He stated that the full panel will convene on September 3 at 12:00. On the platform X, Rosati reminded on Saturday that “an absolute majority of votes is required to adopt a resolution on lifting immunity, with at least two-thirds of the State Tribunal members present.”
