Prosecutor General Waldemar Żurek submitted on Tuesday to the Constitutional Tribunal (TK) a request to hold the judge and president of the Constitutional Tribunal Bogdan Święczkowski criminally accountable.
This is another episode in the political campaign against the independent Constitutional Court and its members.
According to the National Prosecutor’s Office (PK), the basis for submitting the request is evidence gathered by a team appointed to examine the legality, justification, and correctness of the use of Pegasus software by public officials in connection with operational activities carried out by the services.
The prosecution claims that Bogdan Święczkowski allegedly ordered – without first issuing the required written authorization – a review of operational and intelligence activities conducted against Roman Giertych, the scope and objectives of which exceeded the limits of that review.
Under the Act on the Status of Judges of the Constitutional Tribunal, a judge of the Tribunal cannot be held criminally liable without the consent of the General Assembly.
