Żurek’s Defeat in the Romanowski Case. “His Conduct Confirms Judge Łubowski’s Reasoning”

“This shows that the entire act of revenge—the political vendetta planned by Tusk and carried out by Żurek—is a waste of time,” said Law and Justice (PiS) MEP Adam Bielan, referring to the court’s decision to overturn the European Arrest Warrant against Marcin Romanowski. He emphasized that the court’s reasoning in this case demonstrates a lack of impartiality within the Ministry of Justice.

The court overturned the European Arrest Warrant against Marcin Romanowski. In his written justification, Judge Dariusz Łubowski shared the defense counsel’s view that the proceedings involved political pressure. The decision was criticized by Justice Minister Waldemar Żurek, who announced that he would resubmit the request for a European Arrest Warrant and warned that if the case were to return to the same judge, the prosecution would seek his exclusion from the proceedings.

“A Vendetta Is a Waste of Time”

The issue was discussed on the program “High Voltage” broadcast on Telewizja Republika. PiS MEP Adam Bielan stated that Judge Łubowski’s ruling was “crushing for the Ministry of Justice” and includes quotations from the head of the ministry that testify to a complete lack of impartiality.

“In essence, after this Mr. Żurek should immediately resign. All the more so because in his statement he claims that he will seek to have the judge removed, which—as we know under Polish law—is absolutely impossible. This shows that this entire act of revenge, the political vendetta planned by Tusk and carried out by Żurek, is a waste of time,” he assessed.

He pointed out that Żurek has done a great deal to “subordinate the courts,” recalling the removal of the case-randomization mechanism and the replacement of court presidents against the wishes of the judges themselves.

“I hope that, following the example of this judge, others—not only judges but also prosecutors—will begin to refuse to carry out political verdicts that Żurek is trying to issue against people who disagree with the current authorities, because sooner or later every such decision will be held to account,” he said.

“The Pressure Is Clearly Visible”

Paulina Matysiak, who was present in the studio, noted that in 2024 Judge Łubowski had ruled that Romanowski could be pursued under a European Arrest Warrant. This year, however, he changed his view after new arguments reached him. “Please look at what is happening. In 2024 neither Żurek nor attorney Giertych, nor the MP—no one even mentioned the ruling the judge issued in Mr. Romanowski’s case. But when in 2025 the ruling does not suit today’s authorities, there is a huge outcry,” she stated.

Assessing Żurek’s reaction, she said it confirms the theses set out in Łubowski’s reasoning. “One can, of course, discuss the linguistic style and the wording used in that justification, but the core thesis—that the executive branch is exerting pressure on the judiciary—is clearly evident,” she concluded.
