President Karol Nawrocki is taking action regarding the selection of new judges to the Constitutional Tribunal. As announced by the head of state’s spokesperson, Rafał Leśkiewicz, an official letter on the matter will reach the Speaker of the Sejm as early as Wednesday. Włodzimierz Czarzasty has already reacted.
On Friday, the Sejm of the Republic of Poland adopted a resolution on actions “necessary to ensure that the Constitutional Tribunal meets the requirements of a court established by law, independent and impartial.” On the same day, the Sejm—by votes of the ruling coalition—selected six individuals for vacant judicial positions in the Constitutional Tribunal – the first vacancies emerged in December 2024, with further ones in April and December 2025.
Under the law, judges must be sworn in by the president. It remains unclear whether and when Karol Nawrocki will administer the oath to the six candidates nominated by the Sejm. Asked about this on Friday by journalists in parliament, the head of the Presidential Chancellery, Zbigniew Bogucki, did not give a direct answer. However, he admitted that the parliamentary majority could have filled the Tribunal “step by step, in accordance with the constitution.”
What will President Nawrocki do? Waldemar Żurek, the Minister of Justice, “threatened” the head of state a few days ago by issuing an “ultimatum.” He demanded that the oath be taken from the new judges within a week; otherwise, he announced the implementation of a so-called “Plan B.”
Today, in an interview with Wirtualna Polska, presidential spokesperson Rafał Leśkiewicz said that Karol Nawrocki would send a letter to the Speaker of the Sejm, Włodzimierz Czarzasty, later today – precisely regarding the judges.
“There are several doubts that need to be resolved from a formal and legal standpoint. The president is aware that the judges of the Constitutional Tribunal were elected by the Sejm. The concerns relate to the very mode and procedure of their selection, because the first vacancies in the Tribunal appeared at the end of 2023,” the presidential spokesperson pointed out.
He added that “the president is interested in how it happened that for two years the ruling camp questioned the selection of Constitutional Tribunal judges, and then suddenly, through a single move by Speaker Czarzasty, within 48 hours the procedure for nominating candidates for Constitutional Tribunal judges was established, and those candidates were then elected by the Sejm.”
Czarzasty to the President: Don’t Play with Poland
During today’s press conference, Włodzimierz Czarzasty said that he had addressed President Karol Nawrocki because “this all looks unambiguous.”
“We are playing with timing. Mr. President, do not play with Poland. You say you are a courageous man. Do not hide behind Mr. Święczkowski,” he said.
He added: “Make a decision, do not be afraid, act as you should. I am sending you a letter.”
“Mr. President, I wish you courage. I am waiting for your decision,” he concluded.
