Arrest Warrant for Zbigniew Ziobro. Defense: “The Decision Is Unenforceable”

Attorney Adam Gomoła, one of Zbigniew Ziobro’s defense lawyers, has submitted motions to the court to resolve doubts regarding the enforcement of the decision to arrest the former minister of justice and to suspend the execution of that decision. “Regardless of its lack of grounds, at this moment it is unenforceable,” he emphasized.


A few days ago, during the third hearing in this case, the court ordered three months of pretrial detention for Zbigniew Ziobro. Later, the prosecutor issued a decision to search for the former minister of justice with a wanted notice. A notice with Ziobro’s image and personal details was published on the website of the Warsaw Metropolitan Police Headquarters. The announcement sparked extreme reactions, as it has long been known that Zbigniew Ziobro is in Hungary, where he has received political asylum.

This is knowledge possessed by at least several million Poles – and the politician himself is not hiding it. Recently, on TV Republika, he attempted to inform viewers about his whereabouts, although he encountered an overloaded police hotline.

Ziobro’s defense responds

Immediately after the court’s ruling, the former minister’s defense informed that a motion had been filed to suspend the execution of the arrest decision, but the next day the court announced that it had refused to suspend that decision.

This morning, one of Ziobro’s attorneys, Adam Gomoła, announced on social media that two motions had been submitted to the district court.

In the first, as he indicated, the defense is requesting a resolution of doubts regarding the enforcement of the decision to arrest Ziobro. As the basis for submitting the motion to resolve doubts about the decision, the former minister’s lawyer cited Article 13 of the Executive Penal Code.

The second is a motion to suspend the arrest decision, because – as justified – “regardless of its lack of grounds, at this moment it is unenforceable.”

“Similarly unenforceable would be any potential European Arrest Warrant, issued at the request of the National Prosecutor’s Office,” wrote attorney Gomoła.
