Bąkiewicz Won Against the Prosecutor’s Office. Court Lifted Preventive Measures

Police supervision, the obligation to report leaving his place of residence, and a ban on approaching Polish-German border crossings closer than one kilometer – these were the preventive measures applied to Robert Bąkiewicz since August last year. On Friday, the court fully overturned the prosecutor’s decision to impose them.

The leader of the Border Defense Movement was accused, among other things, of insulting Border Guard officers at the end of June 2025 at the border in Słubice. Bąkiewicz emphasized from the beginning that the case was political in nature and did not admit guilt.

Since August last year, when the first charges were brought against Bąkiewicz by the Gorzów District Prosecutor’s Office, he was subject to police supervision, the obligation to report leaving his place of residence, and a ban on approaching Polish-German border crossings closer than one kilometer. His lawyers then filed a complaint against these measures.

“After considering all arguments and examining the case, the court concluded that there were general grounds for applying preventive measures because there was a high probability that the suspect committed the alleged acts. However, the specific grounds were not met, meaning there was no risk of the suspect fleeing or hiding,” said Judge Barańska-Małuszek.

“For almost half a year, preventive measures were applied to me that should not have been used. I will say it again, I believe this was a form of repression, a restriction of my freedom and freedom of movement,” Robert Bąkiewicz said after leaving the courtroom.

He added that he is pleased with the court’s decision only insofar as one can be pleased when someone takes your property and then returns it after some time. “I still believe that the prosecutor’s proceedings have no grounds, no fundamental grounds for applying not only these repressions against me, but also for the charges that the court will decide on soon,” Bąkiewicz emphasized.
