Bogdan Święczkowski: A Constitutional Coup Is Underway

President of the Constitutional Tribunal, Bogdan Święczkowski, has openly accused leading figures in Poland’s ruling coalition of criminal activity. Speaking candidly on Ewa Bugała’s program, he declared: “In my deepest conviction, this is yet another piece of evidence that a constitutional coup is underway in Poland.”

“The Elections Will Not Be Fair”

Święczkowski also addressed the upcoming presidential election, expressing serious concerns about violations of electoral law by the current government:

“In my view, no — the elections will not be fair, because equal rights in campaign financing are not being ensured,” the Tribunal President stated.
He cited the government’s failure to comply with a Supreme Court ruling on public subsidies for the largest opposition party. Both the Minister of Finance and the National Electoral Commission, he claimed, have disregarded the decision.

Święczkowski further pointed to the government’s refusal to implement a Constitutional Tribunal ruling regarding funding for the Tribunal itself and for the National Council of the Judiciary. He called it “yet another indication that a constitutional coup is in progress”:

“The Tribunal issued a ruling. It has already been forwarded to the Prime Minister, and the justification will follow shortly. I expect the Polish parliament to urgently amend the budget,” he emphasized.

Despite this, Święczkowski said, Finance Minister Andrzej Domański refused to allocate special reserve funds—particularly for judges’ salaries. He commented:

“In his official response, he explicitly stated that his actions are deliberate, premeditated, and fall under dolus premeditatus—that is, carried out with full intent to violate the Constitution and the law on the status of Constitutional Tribunal judges.”

Who’s in the “Organized Criminal Group” Against the State?

Święczkowski did not mince words in accusing the government of breaking the law:

“I suspect that this is being orchestrated by Prime Minister Donald Tusk, members of his cabinet, Sejm Speaker Szymon Hołownia, the Senate Speaker, certain MPs and senators, as well as some prosecutors and judges,” he alleged.

He also issued a warning to Tusk’s allies:

“If, one day, an independent prosecutor determines that a crime under Articles 127 and 128 of the Penal Code has been committed—namely, a constitutional coup—those involved in this organized criminal group could face penalties of up to life imprisonment,” Święczkowski warned.
