Local governments versus patriots
Of course – as every year – there could be no shortage of difficulties related to organizing the great celebration of November 11. This time, the Masovian Voivode issued a bizarre ordinance. It concerns… a ban on carrying pyrotechnic materials within the city limits of Warsaw.
This action prompted a response from the Board of the Independence March Association. The details were presented today at a press conference by its president, Bartosz Malewski.
The Masovian Voivode – just like last year – has issued an ordinance that prohibits carrying pyrotechnic materials within Warsaw on November 11. In our view, this ordinance was issued in violation of the law. Moreover, it constitutes a significant infringement on civil liberties, he pointed out.
In his opinion, “there is no legal basis for the voivode, through a local law act, to prohibit citizens from carrying any objects that are not prohibited in general. That is the first issue,” he said.
“The second issue is that through this ordinance, the voivode is essentially duplicating regulations that already exist. Local law acts, such as ordinances, are issued only when there remains some matter to be legally regulated. In this case, there is no such matter. Obviously, the voivode’s motivation in this regard is undoubtedly the Independence March, which takes place on November 11,” he explained.
According to the president of the Independence March Association, “the voivode is deliberately issuing such an ordinance so that no one in Warsaw may even possess pyrotechnic materials.”
“This, of course, meets with our objection. Therefore, today, through the Masovian Voivode – in accordance with the procedure – we are submitting an administrative complaint to the Provincial Administrative Court (WSA). In this complaint, we raise specific allegations of legal violations by the voivode, hoping that the WSA will consider this complaint promptly and, of course, annul the ordinance. We are also filing a motion to suspend the enforcement of this ordinance until our complaint is reviewed by the WSA,” he added.
