Two chambers of the Supreme Court will issue a very important ruling today. In front of the courthouse, members of the Gazeta Polska Clubs gathered to show their public support. “We do not want courts to have party colors, we want them to be fair,” said Adam Borowski, head of the Warsaw Gazeta Polska Club.





Important Supreme Court session
Today, a joint session of the Chambers of Extraordinary Control and Public Affairs and of Labour and Social Security will take place at the Supreme Court, during which the judges will decide whether the ruling of the Supreme Court – the Chamber of Extraordinary Control and Public Affairs issued by a panel including at least one judge appointed at the request of the National Council of the Judiciary (KRS) after 2018 – produces legal effects. A three-judge panel of the Supreme Court requested clarification following the September resolution adopted by some judges of the Chamber of Labour and Social Security. That resolution stated that rulings issued by the Chamber of Extraordinary Control and Public Affairs should be treated as invalid because it includes so-called “neo-judges”. Moreover, the resolution was given the status of a legal principle, meaning it became binding for all Supreme Court panels. It can therefore be expected that during Wednesday’s session the judges will oppose attempts to undermine their legality by giving an affirmative answer to the question posed.
Demonstration of the Gazeta Polska Clubs
Members of the Gazeta Polska Clubs, activists of the Border Protection Movement, as well as members of the Free Poles organization appeared on site to show public support for representatives of the independent judiciary. The head of the Warsaw Gazeta Polska Club, Adam Borowski, emphasized in a conversation with our reporter that cooperation between these three organizations is extremely important because “the time for Poland is difficult, we must be united, like one fist, because freedom is never given once and for all”.
“These two chambers are to convene today and declare that the constitution is our highest law, not international courts that usurp the right to organize our judiciary. The Lisbon Treaty did not provide for this and left the organization of the judiciary to nation states. Everything Żurek agrees to is simply external interference in our internal affairs. We are here to support the Extraordinary Control Chamber, which, I hope, will rule that the constitution is our highest law and that is why it is being questioned by those currently in power,” he assessed.
He also pointed out that the presence of the GP Clubs is meant “to support the independent judiciary that resists subordination to those in power“.
“They must know that they have the support of society. We do not want courts to have party colors, we want them to be fair. If there is no justice, the state will become weak. This leads directly to the loss of sovereignty. The state must be strong and just,” he concluded.
