“The actions announced by Minister Gawkowski are illegal and contrary to the Constitution. No EU body stands above the Constitution of the Republic of Poland,” stated Law and Justice (PiS) MP Mariusz Błaszczak. The politician commented in this way on Gawkowski’s announcements regarding same-sex marriages.

At the end of November 2025, the Court of Justice of the European Union ruled that member states are obliged to recognize marriages of same-sex couples concluded in other EU countries, even when national regulations – as is the case in Poland – define marriage solely as a union between a woman and a man. Minister of Digital Affairs Krzysztof Gawkowski recently announced the signing of documents initiating the process of changing the templates of civil status records. As he emphasized, the goal of these actions is to ensure the “efficient and equal functioning of the state toward all citizens”. The planned changes are intended to align Polish law with the CJEU ruling and create a legal basis for recognizing same-sex marriages.
Gawkowski’s announcement was addressed by PiS MP Mariusz Błaszczak in a post published on the X platform.
“The claim that “Poland is obliged to recognize same-sex marriages” is inconsistent with the Constitution of the RP. According to Article 18 of the Constitution, marriage as a union between a woman and a man is under the protection and care of the Republic of Poland,” the politician pointed out.
According to Błaszczak, “referring to the ruling of the Court of Justice of the European Union as supposedly ‘clear’ and absolutely binding in the area of Polish family policy is an abuse”.
The CJEU does not have the competence to interfere with the constitutionally defined model of marriage in member states. The competences of the Union in the area of family law have not been granted to it in the treaties, and pro-family policy and the status of marriage remain the domain of national states, he reminded.
The PiS MP indicated that the actions Gawkowski announces “are illegal and contrary to the Constitution”.
“No EU body stands above the Constitution of the RP, and the minister has no right to change the structure of the state by regulation,” he concluded.
