Why did the National Health Fund (NFZ) file a criminal complaint nearly a year after its audit had concluded? NFZ President Filip Nowak claims that “new circumstances” emerged only recently. Moments later, however, he explained that those circumstances were… public statements made by Dr. Emil Jędrzejewski, who had previously exposed alleged irregularities at Warsaw’s South Hospital.
Yesterday, it became public that Dr. Emil Jędrzejewski, the former head of the General and Proctological Surgery Department at Warsaw’s South Hospital, who had spoken publicly about alleged irregularities at the facility, had himself become the subject of a prosecutor’s investigation. The NFZ president filed a complaint alleging that false information had been certified in the settlement of medical procedures. However, successive prosecutor’s offices have declined to handle the case.
According to Gazeta Wyborcza, the complaint filed by the NFZ president on July 8 is linked to the findings of an audit carried out in 2025 at the General and Proctological Surgery Department of Warsaw’s South Hospital. The audit examined the legitimacy of medical services provided between January 1 and December 31, 2024. The NFZ launched the audit based on an analysis of reports submitted by the hospital.
As Gazeta Wyborcza explained, the audit found that contracted medical procedures had been incorrectly billed. In particular, it concerned so-called “major and endoscopic procedures for inflammatory bowel diseases,” for which the department received substantially higher reimbursement from the NFZ than for “intermediate and endoscopic procedures of the lower gastrointestinal tract.”
In 2024, Dr. Emil Jędrzejewski headed the General and Proctological Surgery Department. He later became a whistleblower for Kanał Zero, revealing alleged irregularities at South Hospital.
The complaint was initially submitted to the Warsaw District Prosecutor’s Office. On Monday, its spokesperson, prosecutor Piotr A. Skiba, announced that the case had been transferred to the Regional Prosecutor’s Office in Warsaw.
Why was the complaint filed only now?
NFZ President Filip Nowak appeared on TVP Info’s morning program today. Asked about the complaint concerning Dr. Jędrzejewski, he said:
“We are dealing here, so to speak, with deliberate conduct that prompted us, as public officials, to notify the prosecutor’s office.”
When asked why he had waited a year to file the complaint, given that the audit had concluded in September 2025, Nowak replied:
“I didn’t wait a year. Circumstances emerged last week or two weeks ago that I simply didn’t know about a year ago.”
The interviewer then asked:
“So the audit itself did not indicate that Dr. Emil Jędrzejewski may have been reporting more expensive procedures while actually performing cheaper ones?”
Nowak responded:
“No. What we didn’t know was whether it had been intentional. Last week, the doctor himself stated publicly that it had been deliberate and aimed at obtaining higher funding. Not every mistake, not every incorrectly reported medical service automatically constitutes a criminal offense. Very often it may simply result from an error.”
Investigation into alleged assault discontinued
Meanwhile, Patryk Słowik, a journalist with Zero.pl, reported today that:
“The investigation into the alleged assault of Dawid Kacprzyk by the former head of surgery at South Hospital, Dr. Emil Jędrzejewski, has been discontinued, Zero has learned. Police confirmed that the decision was made because there were no elements of a criminal offense. In other words, no assault took place. The prosecutor’s office also confirmed this information to us.”
