Supreme Administrative Court Dismisses Chancellery Appeals – Sławomir Cenckiewicz Case Settled

The Supreme Administrative Court dismissed the cassation appeals filed by the Chancellery of the Prime Minister against rulings of the Voivodeship Administrative Court, which had overturned the revocation of the security clearance of the current head of the National Security Bureau, Sławomir Cenckiewicz. What does this mean?

Supreme Administrative Court rules on the head of the National Security Bureau

In a statement issued today, the Supreme Administrative Court said:

“Revocation of security clearances regarding access to classified information – judgment of April 15, 2026, case no. III OSK 1694/25.

In today’s ruling, the Supreme Administrative Court dismissed, after joining them for joint examination and resolution, the cassation appeals of the Prime Minister against the judgments of the Voivodeship Administrative Court in Warsaw of June 17, 2025, in cases with reference numbers: II SA/Wa 153/25, II SA/Wa 154/25, II SA/Wa 155/25, II SA/Wa 156/25, II SA/Wa 157/25, II SA/Wa 158/25, II SA/Wa 159/25, II SA/Wa 152/25.

These judgments were issued in cases concerning complaints against decisions of the Prime Minister on the revocation of security clearances granting access to classified information at the levels specified in the rulings.

Pursuant to Article 38(2) of the Act of August 5, 2010 on the protection of classified information, the case was examined in a closed session, and due to the sensitive information contained in the reasoning of the judgment, the reasoning will not be made publicly available by the Supreme Administrative Court.”

What does this mean in practice? The Supreme Administrative Court found that the appeals filed by Donald Tusk’s Chancellery were unfounded and dismissed them. As a result, it upheld the earlier rulings of the lower court, which determined that revoking the security clearance of the current head of the National Security Bureau, Sławomir Cenckiewicz, had been improper.
