The Prosecution Hid Evidence in His Favor. Ziobro: “This Is Its Disgrace and a Violation of the Law”

“It is certainly a disgrace and another violation of the law. It is hard to call this a prosecution service if it is completely subordinated to the party interests of Donald Tusk,” Zbigniew Ziobro said in assessing today’s defeat of the prosecution in court. At the detention hearing, the court decided not to grant the prosecution’s motion to remand Ziobro in custody. It was indicated that the prosecution had not submitted the complete set of evidence in the case to the court. It turned out that there had been attempts to conceal from the court those pieces of evidence that were favorable to Ziobro.

The District Court for Warsaw-Mokotów postponed until mid-January the hearing on the possible detention of former justice minister and Law and Justice (PiS) MP Zbigniew Ziobro. In doing so, it accepted the defense’s motion. “We are somewhat perplexed that the prosecution does not present the court with the entirety of the case files, since an immanent part of the evidentiary material consists of both open and classified materials,” said attorney Adam Gomoła, counsel for the former justice minister.

The case was commented on by the person concerned himself, Zbigniew Ziobro, on the air of TV Republika.

“There is a legal principle that says evidence should be presented both for and against. However, I do not believe that the evidence the prosecution has presented so far is to my detriment. The interpretation of this evidence in no way allows for the conclusions insinuated by the prosecution,” he said during a telephone connection.

“How can one justify the claim that transferring funds for the purchase by Polish special services of a system for breaking encrypted communicators, indispensable in any modern state, constituted a crime? They submitted documents that supposedly indicate this – open documents. But they did not present those which, in the justification, pointed to the decision and stemmed from classified documentation,” he emphasized.

He recalled that one of his defense attorneys who had reviewed the case files clearly stated that the prosecution had also failed to submit to the court other documents that spoke in favor of Zbigniew Ziobro. “But even the open ones they submitted – I am not convinced they were to my detriment. It was the right decision and it is good that it was taken. Thanks to it, numerous crimes were uncovered and such things as the activities of foreign intelligence services were prevented,” Ziobro added.
