The legal association Veritas Et Ius in Service to the Nation has raised the alarm, claiming that Donald Tusk’s government is deliberately refusing to publish rulings issued by the Constitutional Tribunal in order to save approximately PLN 10 billion at the expense of 200,000 pensioners.
Pensioners Deprived of Compensation They Are Owed
In a post on the X platform, the association stated that during the public hearing of Sylwia Gregorczyk-Abram, who was nominated for the position of Commissioner for Human Rights and was ultimately elected to the office, the association’s spokesperson, Judge Kamila Borszowska-Moszowska, asked about her stance on the government’s refusal to publish Constitutional Tribunal rulings – including those concerning early retirement pensions. Gregorczyk-Abram admitted that she does not recognize the Constitutional Tribunal and, consequently, does not recognize its rulings either.
The government has still not published the ruling concerning early retirement pensions. It has, however, promised citizens legislation that would amend the regulations and implement the solutions resulting from the Tribunal’s judgment.
“And what has turned out to be the case? The current draft law completely deprives pensioners of the compensation they are entitled to. Instead of correcting the injustice that was done, the state is once again trying to save money at the expense of senior citizens.
We are talking about approximately 200,000 eligible pensioners. The average compensation could amount to around PLN 64,000 per person. Altogether, this concerns an estimated PLN 10 billion that the state may ultimately refuse to pay.
Once again, everything is happening at the expense of the most vulnerable. The state first applies unjust regulations, then refuses to publish the ruling, and finally prepares legislation that strips those affected of their right to full compensation.
Perhaps this is precisely why those in power are so eager to remove the President of the Constitutional Tribunal, who has been calling for the publication of the Tribunal’s rulings. Is it because they do not want anyone reminding the government of its obligations toward citizens?
We remember what happened in 2014, when funds from the Open Pension Funds (OFE) were transferred to the State Treasury. Today, one may get the impression that a similar mechanism is being prepared – once again at the expense of citizens, this time pensioners.”
This was emphasized in the association’s appeal.
