They are pursuing Ziobro over contracts with foundations that the Justice Fund (FS) continues to pay millions to today

The prosecution is seeking to lift Zbigniew Ziobro’s immunity, accusing him of allegedly illegal financing of foundations from the Justice Fund (FS). At the same time, as our findings show, the current leadership of the Ministry of Justice, headed by Waldemar Żurek (and previously Adam Bodnar), is still transferring millions to the same entities, based on the very same contracts!

In the prosecution’s motion to lift Zbigniew Ziobro’s immunity and in the charges against Marcin Romanowski, the institutions alleged to have received grants in violation of the law were listed. However, it turns out that four of these organizations, under the same terms, continue to receive money from the Justice Fund, which is now managed by people from the new administration.

Although financing for some foundations and companies that were granted subsidies during the United Right government was halted in 2024, others still continue to receive payments. Even though the prosecution – in its motion against Ziobro – accuses him of irregular transfers to entities such as the Give Children Strength Foundation, Lumus, Compassio, and the Academy of Sport, the funding for these organizations has not been suspended. They continue to receive money based on contracts signed in 2023, with the full knowledge and consent of the current Ministry of Justice authorities. This happens even though those very contracts are supposed to serve as evidence in the case against Ziobro and Romanowski.

And these are not small amounts. In 2025 alone, the Justice Fund paid:

  • Give Children Strength Foundation – over PLN 3 million,
  • Lumus – PLN 2.1 million,
  • Compassio – PLN 707,000,
  • Academy of Sport – PLN 1.7 million.

In total, that amounts to over PLN 7.6 million. According to data as of June 27 this year, it is likely that each of these entities has already received a second tranche, which means the actual amount may reach as much as PLN 10 million.

And that is not all. One of the projects carried out by the Give Children Strength Foundation – based on the same contract for which Ziobro is being pursued – has received the patronage of some of the highest-ranking figures in the current government: Speaker of the Sejm Szymon Hołownia, Speaker of the Senate Małgorzata Kidawa-Błońska, and even Secretary of State in the Chancellery of the Prime Minister (KPRM) Katarzyna Kotula.

The Give Children Strength Foundation informed the editorial team in an email that in its case, the National Revenue Administration (KAS) found no irregularities, issued no recommendations, and filed no report with the prosecution. It referred to a scan from the KAS audit report. The Ministry of Finance, in a statement dated October 30, 2025, confirmed that the National Revenue Administration had conducted audit activities regarding public funds (including those involving the Give Children Strength Foundation).

How is it possible that Ziobro and Romanowski are charged with attempting to misappropriate funds in connection with specific contracts, while on the basis of those same contracts, the current government is paying out at least PLN 7.6 million?

If one were to follow the prosecution’s logic, it would mean that the Ministers of Justice in Donald Tusk’s government have misappropriated these sums, committing a crime under Articles 231 §2, 284 §2, and 294 §1 of the Criminal Code, punishable by up to 20 years in prison.
