Based on rulings by the Court of Justice of the European Union and the Supreme Administrative Court, the Warsaw Civil Registry Office will carry out transcriptions of certificates of so-called same-sex marriages of Polish citizens concluded within the EU. Rafał Trzaskowski announced on X that Warsaw City Hall had long been working on preparing for the process of the first such transcription in the country, despite the lack of regulations at the national level.
Trzaskowski assured on X that his views on LGBTQ+ issues are widely known and are not limited solely to activity on social media: “they are reflected in concrete actions.”
“I am pleased”
“Today we received documents regarding the transcription of the ruling of the Supreme Administrative Court. Therefore, I am pleased that, based on the judgment of the Court of Justice of the European Union from November 2025 and subsequent rulings of the Supreme Administrative Court, the Warsaw Civil Registry Office will in the coming days carry out the transcription of a same-sex marriage certificate in cases where courts have already issued rulings. At the same time, I have decided that, based on the above court decisions, and thus in light of the emerging case law, in the next step the Civil Registry Office will carry out transcriptions of same-sex marriages of Polish citizens concluded in the territory of European Union member states, who have applied or will apply for such transcription to the Civil Registry Office,” wrote Trzaskowski.
He expressed satisfaction with the announcement by Donald Tusk regarding a regulation intended to standardize transcriptions nationwide. He emphasized that he hopes for its swift adoption and implementation.
“As the head of the Civil Registry Office in Warsaw, I operate within the limits of the applicable law, including statutes, regulations, and court rulings – both Polish and European. And that is precisely why, when most politicians and commentators limited themselves to commenting, we were working on preparing for the court-mandated process of the first transcription of a same-sex marriage in the country, despite the lack of regulations at the national level,” emphasized the Mayor of Warsaw.
He added that until a systemic solution is introduced, i.e., a regulation on document templates in the field of civil status registration, “transcriptions will be carried out within the existing technical capabilities.”
He stressed that he hopes further rights will be defined, among others, “through the swift adoption of an act on the status of a closest person; therefore, this must take place at the state level – through legislation or court rulings.”
Let us recall that today Donald Tusk announced finding solutions and undertaking rapid work on a regulation, followed by a bill on the legalization of same-sex marriages.
