On what grounds could Ryszard Cyba, a murderer sentenced to life imprisonment, have been released from prison? A document obtained by TV Republika contains an important clue. In this case, essentially only one scenario seems plausible—illness, either mental or another chronic condition.

On Monday, TV Republika revealed that Ryszard Cyba—the murderer of Law and Justice (PiS) activist Marek Rosiak—had been released. The killer served just over 14 years in prison, although, according to the court ruling, he was eligible to apply for early release only after 30 years of incarceration, which would have been in 2040.

In the document disclosed by TV Republika, it is stated that Cyba was released from the Penal Institution in Czarne on March 18, 2025. The reason: “suspension of enforcement proceedings.”

Under what legal provisions was Cyba released? This is clarified in Article 15, §2 of the Executive Penal Code:

"If there exists a long-term impediment preventing the enforcement proceedings, and in particular, if the convicted person cannot be apprehended or the sentence cannot be carried out due to mental illness or another chronic, severe illness, the proceedings shall be suspended, in whole or in part, for the duration of the impediment."

Since Cyba had been apprehended and was serving time in prison, the only plausible basis in the case of the nearly 77-year-old murderer could have been a mental illness or another chronic condition.

Further provisions of Article 15 of the Executive Penal Code state:

“An appeal may be lodged against a decision regarding the discontinuation or suspension of enforcement proceedings. The suspension of enforcement proceedings does not interrupt the statute of limitations, unless the convicted person is evading the execution of the sentence. The period during which the statute of limitations is suspended may not exceed 10 years.”
