Will there be cross-party support for the PiS bill? Proposal aims to toughen rape penalties

“We have prepared a draft law intended to provide special protection for women who are in relationships of professional dependence, where there is a risk that this dependence could be exploited against them. An example is the case of the policewoman from Piaseczno who was raped. Such actions cannot be accepted,” said PiS MP Ewa Leniart.

PiS proposes increasing penalties for rape

Today, the Sejm held the first reading of a bill authored by PiS MPs that envisages tougher penalties for the sexual exploitation of a person in a relationship of dependence or in a difficult situation. The draft proposes raising the basic penalty to between 1 and 10 years of imprisonment.

If the victim is a minor, the penalty would increase from the current 3 months to 5 years to 2-15 years of imprisonment. The bill also introduces a new, more severe category of offense punishable by 3 to 20 years in prison for abusing a position of special trust or authority, for example, in relationships such as superior-subordinate, therapist-patient, teacher-student, or caregiver-dependent.

Female PiS parliamentarians held a press conference today, during which they discussed the details of the proposal.

“We have prepared a draft law that is meant to provide particular protection for women who are in relationships of professional dependence, where there is a risk that this dependence could be used against them. The case of the policewoman from Piaseczno who was raped is an example. Such actions cannot be accepted. That is why the PiS parliamentary club has prepared a proposal to amend the legal provisions to ensure increased protection for women. We believe that the parliamentary majority will support this project,”

said MP Ewa Leniart.

MP Anna Krupka emphasized that they want “this project not to be subject to party interests, but rather to set the direction for changes concerning women’s safety.”

“Harsher penalties have a deterrent effect, and therefore we believe they will increase women’s safety. We want to strengthen the safety of those who remain in relationships of dependence,”

she declared.

MP Agnieszka Wojciechowska van Heukelom added:

“We want to amend these provisions regarding stricter penalties for rape, particularly in cases involving relationships of dependence. We want to show that it is possible to effectively fight for women’s real rights to dignity, bodily integrity, and the right to be treated with dignity and respect. With this law, we have shown that it can be done.”
