During the taking of successive pseudo-oaths, Law and Justice (PiS) politician Łukasz Kmita pointed out to those present in the Column Hall that the President of Poland was not in the room. “But the President is not here,” he said, which briefly halted Magdalena Bendkowska as she was about to take the oath again.
Journalists were not allowed to attend the absurd situation that took place in the Sejm. However, members of parliament were present in the Column Hall. When lawyers declared that they were swearing “before the President,” Law and Justice (PiS) MP Łukasz Kmita reminded them that the President was not in the room.
This statement of fact briefly stopped Magdalena Bendkowska, who was preparing to take the “oath” again. However, she did not deviate from her course and read out the prepared formula.

After the brief official part, Kmita spoke to the media and explained his behavior.
“I informed those who took part in the ‘ceremony’ that the President of the Republic of Poland was not there. Both the former President of the Constitutional Tribunal and the anti-judges were taking an alleged oath before a President who was not present. Many must have thought that the President of the Republic of Poland was Rafał Trzaskowski,” Kmita said.
He assessed that the entire set of actions was unconstitutional.
He added that “only Czarzasty was smiling.”
“The other deputy marshals are probably aware that they were participating in some kind of show, in an action that violates the law and the constitution. That is why I felt obliged to inform them that the President of the Republic of Poland was not there, that this was an illegal action, and those were the words I spoke. It did not change the attitude of the anti-judges, but I think everyone is convinced that this is not a legal action,” he stressed.
