Judge Przemysław Radzik, the lawful Deputy Disciplinary Spokesperson for Ordinary Court Judges, received a letter today demanding that he immediately cease performing his duties and vacate the offices he occupies within the National Council of the Judiciary (KRS). Similar letters were sent to judges Piotr Schab and Michał Lasota. The authors of the letter are 13 judges who recently became members of the KRS and who ran from a list recommended, among others, by the judges’ association Iustitia. “We will not comply with this demand and will continue carrying out our duties,” Judge Radzik told Niezalezna.pl.
The Disciplinary Spokesperson for Ordinary Court Judges and his two deputies received a letter today from the new members of the National Council of the Judiciary. Without citing any legal basis, the letter demands that they leave the offices they occupy in the KRS headquarters.
Judge Przemysław Radzik posted the letter on X.
“As members of the National Council of the Judiciary representing the majority of the members of this body, we hereby call on you to immediately cease performing any duties as Deputy Disciplinary Spokesperson for Ordinary Court Judges and to vacate the premises you occupy in connection with that function at the headquarters of the National Council of the Judiciary.”
Nearly identical letters were also sent to judges Piotr Schab and Michał Lasota.
Niezalezna.pl asked Judge Radzik for comment.
“First of all, this body is not yet operational because it has not held a session. Secondly, both my colleagues and I perform our functions on the basis of statutory law. The KRS is obliged to provide us with administrative and technical support. Our terms of office are ongoing. We are performing our duties legally, as confirmed by three KRS resolutions. Furthermore, our legal status has also been confirmed by the case law of the Supreme Court,” he said.
He stressed that “this action (the demand – editor’s note) is politically motivated and has no legal basis.”
“It borders on a criminal offense under Article 224 of the Penal Code,” Judge Radzik added.
“We will not comply with this demand and will continue carrying out our duties. The KRS has absolutely no authority to issue such demands,” he said.
Asked whether he feared further actions, such as the involvement of state services and forcible removal from the offices, he replied:
“I have no doubt that steps aimed at removing us from the premises we legally occupy within the KRS will be undertaken.”
“I regard this as a reaction to yesterday’s decision and the bringing of charges against Judge Raczkowska. Incidentally, there are reports that Colonel Raczkowski, Judge Raczkowska’s husband, is expected to become the head of the KRS office,” he said.
“Of course, we will not yield. We will continue performing our duties,” he assured.
The move by the KRS members was also criticized by the Lawyers for Poland association, which responded with the following statement:
