Pabianice Medical Center (PCM) has taken legal action against the National Health Fund (NFZ) after being fined 550,000 PLN in June 2024 for refusing to perform a legal abortion. The fine was initially imposed following an investigation by the Patient Rights Ombudsman, who concluded that the hospital violated the rights of one of its patients by denying the procedure.
NFZ Reduces Fine Amid Dispute
In response to PCM’s appeal, the NFZ reduced the fine to 250,000 PLN. However, this decision has not satisfied the hospital’s administration, which maintains that the penalty is unjustified. PCM argues that their position was clearly communicated to the NFZ on June 26, 2024.
Continuing its fight, PCM has initiated legal proceedings against the NFZ, seeking to overturn the fine entirely. Additionally, on August 12, 2024, the hospital management filed a request to the court to block the NFZ from deducting the reduced fine from their funds.
The outcome of this legal battle could set a significant precedent for how similar cases are handled in the future, as the healthcare institution remains steadfast in its stance against the imposed penalty.
