Prosecutor and police enter Constitutional Tribunal headquarters. They were accompanied by self-proclaimed judges

A prosecutor accompanied by police officers entered the headquarters of Poland’s Constitutional Tribunal on Tuesday together with four individuals claiming to be Constitutional Tribunal judges. Prosecutor Andrzej Piaseczny declined to answer questions from Telewizja Republika reporter Michał Gwardyński. He left the Tribunal building after several minutes.

The Constitutional Tribunal (TK) is holding a General Assembly of its judges today. The agenda includes organizational matters, such as the Tribunal’s draft budget for the coming year and approval of a report on significant issues arising from the Tribunal’s activities and case law in 2025, which is part of the institution’s standard annual procedures. A quorum of at least 10 judges is required for both matters.

Also present at the Tribunal’s headquarters were Krystian Markiewicz, Maciej Taborowski, Marcin Dziurda, and Anna Korwin-Piotrowska, who claim the right to participate in the Tribunal’s work. The four were elected by the Sejm in March to serve as Constitutional Tribunal judges but have not taken the oath of office before the President of the Republic of Poland.

They were accompanied by Prosecutor Andrzej Piaseczny and police officers. Telewizja Republika reporter Michał Gwardyński asked the prosecutor why he had come to the Constitutional Tribunal, but Piaseczny refused to comment. Attention was also drawn to a mysterious briefcase he was carrying. When asked about its contents by another reporter, the prosecutor replied that any questions should be directed to the police.

After several minutes, the prosecutor left the Constitutional Tribunal building and departed together with the police officers in a van.

Letter to the President of the Constitutional Tribunal

In recent days, the four aforementioned judges, along with Magdalena Bentkowska and Dariusz Szostek—who were sworn in by President Karol Nawrocki—sent a letter to Constitutional Tribunal President Bogdan Święczkowski, demanding that all judges elected by the Sejm in March be immediately allowed to participate in the Tribunal’s work.

This is not the only form of pressure. On June 24, when another General Assembly of Constitutional Tribunal judges was scheduled to take place, Krystian Markiewicz and Marcin Dziurda entered the meeting room and refused to leave. Meanwhile, Judges Bentkowska and Szostek delayed signing the attendance list, prompting President Święczkowski to declare that there was no quorum and to adjourn the meeting. To prevent a similar situation from recurring, today’s assembly is being held in a different room than usual.
