Attorney Bartosz Lewandowski announced on the X platform that Deputy Prosecutor General Robert Hernand has been finally cleared of disciplinary charges related to the widely publicized recording of his exchange with Adam Bodnar.
“The Disciplinary Court attached to the Prosecutor General did not uphold the appeal filed by the Minister of Justice–Prosecutor General, personally signed by Waldemar Żurek,” Lewandowski wrote.
In 2024, then-Minister of Justice Adam Bodnar moved to take control of the National Prosecutor’s Office and swiftly appointed Jacek Bilewicz as its acting head. During events at the National Prosecutor’s Office headquarters, an exchange took place between Bodnar and Deputy Prosecutor General Robert Hernand.
“Your actions are unlawful,” Hernand told Bodnar. A recording of the incident later appeared online and gained nationwide attention.
As a result of recording the conversation, disciplinary proceedings were initiated against Hernand. The case was subsequently discontinued, but an appeal was filed by the current Prosecutor General, Waldemar Żurek.
However, Hernand has now been fully cleared of the disciplinary allegations, according to a statement by his legal representative, attorney Bartosz Lewandowski.
“The Disciplinary Court attached to the Prosecutor General did not accept the appeal of the Minister of Justice–Prosecutor General, personally signed by Waldemar Żurek, in which he challenged the decision of the Disciplinary Ombudsman to discontinue the disciplinary proceedings on the grounds of the negligible social harmfulness of the act,” Lewandowski stated on X.
He added that “all of the arguments contained in the Prosecutor General’s appeal could not be accepted, and the procedural decision was correct.”
“After two and a half years, Prosecutor Robert Hernand has finally been cleared of disciplinary charges for the ‘offense of insulting the majesty’ of Adam Bodnar and for recording the takeover of the Prosecutor’s Office by the governing majority—a video that was seen by all of Poland,” Lewandowski added.
