‘So European Commission’s bureaucrats confirmed in writing. There is no definition of the rule of law in the European Union’s documents. The issue of the rule of law does not belong to EU level’ – wrote the Member of the European Parliament, the former Minister of Foreign Affairs on his Twitter account. He also attached the Commission’s reply for his parliamentary interpellation concerning the rule of law.
The former Minister of Foreign Affairs published the reply for his parliamentary interpellation concerning the rule of law. Member of the European Parliament asked about the ‘definition of the rule of law’, its legal basis and ‘the objective criteria aimed at monitoring the rule of law’.
According to the reply of European Commission, ‘there is no legally binding instrument defining the rule of law’ and ‘Commission resorts to European Council’s rules and recommendations, which is not a Union authority’.
‘It is obvious that the mentioned Commission is not able to give precise and legally binding criteria. It is very dangerous because it leads to arbitrary and discretionary behaviours which have nothing to do with the rule of law’ – said Waszczykowski.
The former Minister of Foreign Affairs admitted that ‘it was a good thing’ that Poland and Hungary took advantage of veto and ‘blocked harmful mechanisms’.
