Tomorrow, lawyers will submit formal filings to the relevant authorities regarding the controversial freezing of the bank accounts of the Niezależne Media Foundation. They will demand the restoration of the rule of law and file criminal complaints against officials from Donald Tusk’s Chancellery, accusing them of exceeding their authority and acting to the detriment of the entities involved.
A notification of suspected criminal offenses, including violations under Article 231 of the Polish Criminal Code (abuse of public office), will be submitted to the District Prosecutor’s Office in Warsaw against Jan Grabiec, head of Donald Tusk’s Chancellery, as well as the head of the Tax Office. At the same time, a request will be filed with the Tax Office seeking the complete discontinuation of the enforcement proceedings. Formal objections to the enforcement procedure will also be submitted to the Chancellery of the Prime Minister through the Tax Office.
As lawyers representing the Niezależne Media Foundation and TV Republika emphasize, “The fundamental principles of Poland’s legal order were flagrantly violated in this case, particularly the principle of protecting citizens’ trust in the state derived from Article 2 of the Constitution of the Republic of Poland, as well as the related principle that administrative proceedings must be conducted in a manner that inspires participants’ confidence in public authorities.”
One of the key allegations is that the case was referred for administrative enforcement even though the funds identified in the enforcement order – which, in the lawyers’ view, is defective due to the lack of a signature and the absence of the formal characteristics of a valid printed document – had already ceased to constitute either a grant or public funds as of 8 December 2023.
According to the legal argument, on that date the creditor – the Chancellery of the Prime Minister – formally and definitively approved the project’s completion in full and accepted the settlement of all expenditures without objections. As a result, the funds lost their legal status as a grant. Furthermore, the enforcement proceedings were initiated before an independent court had even considered the Foundation’s request to suspend the execution of the creditor’s decision. That request, submitted under Article 64 §3 of the Law on Proceedings Before Administrative Courts, was filed with the Provincial Administrative Court in Warsaw through the creditor on 20 June 2026.
This is stated in the justification accompanying the legal action.
The lawyers further stressed that the enforcement order fails to meet the statutory requirements necessary for legal effectiveness because it is neither signed nor issued as a valid printed document.
At the end of the past week, Adam Borowski, the Civic Ombudsman and Chairman of the Warsaw Gazeta Polska Club, called for a public show of support for the Niezależne Media Foundation and its President, Joanna Jenerowicz. He invited supporters to attend a demonstration on 27 July at 2:30 p.m. in front of the prosecutor’s office at Taras Shevchenko Square in Warsaw. The invitation was also endorsed by Robert Bąkiewicz, leader of the Border Defense Movement.
