Loud Echoes of Scandal in Oleśnica: “This is No Longer About Abortion, But About Murder”

“The case of 9-month-old Felek’s death is no longer a matter of abortion, but of the child’s murder,” writes attorney Magdalena Majkowska from Ordo Iuris and the Center for Life and Family. “The killing of a child on the eve of birth was made possible because the government issued ‘guidelines’ that violate the Constitution,” emphasizes attorney Dr. Jerzy Kwaśniewski.

In recent days, the media revealed the case of a woman named Anita who, in the 36th week of pregnancy, underwent an abortion procedure at a hospital in Oleśnica due to threats to her physical and mental health. The nearly 9-month-old fetus was terminated by “induction of asystole” – injecting potassium chloride directly into the heart.

The District Prosecutor’s Office in Oleśnica has launched an investigation into whether the abortion was carried out illegally.

The situation has sparked intense reactions online.

Majkowska: This is No Longer Abortion

“The death of 9-month-old Felek can no longer be described as abortion – it was the murder of a child,” writes attorney Magdalena Majkowska.

She adds that this distinction matters not only in terms of punishment, but also in terms of determining who could potentially bear criminal responsibility – including the child’s mother. “According to media reports, the child was capable of surviving outside the womb. The goal was to end the pregnancy while preserving the child’s life. Felek’s mother was offered a cesarean section and subsequent specialist medical care. Influenced by abortion activists, she refused. She went to the hospital in Oleśnica, where 9-month-old Felek was killed by an injection of potassium chloride into his heart,” Majkowska recounts.

Why does she argue this was murder and not assistance in abortion? She refers to a 2008 Supreme Court ruling:

“In cases where a cesarean section or other alternative means of ending the pregnancy is medically necessary, from the moment such a need arises, the child is entitled to FULL legal protection of life and health.”

Kwaśniewski: Government Guidelines Gave the Green Light

Jerzy Kwaśniewski, head of Ordo Iuris, points out that “the murder of a child on the eve of birth was made possible because the government issued guidelines that break the Constitution.”

“Similar crimes are committed due to a false and overly broad interpretation of the ‘health protection’ provision. What was intended to safeguard health in life-threatening situations has become a pretext for killing children for trivial reasons,” Kwaśniewski wrote.

What guidelines is he referring to?

At the end of August 2024, the Ministry of Health issued “guidelines for hospitals and doctors” regarding abortion procedures. These guidelines emphasized that threats to a woman’s health or life are separate criteria and can include both physical and mental health. Furthermore, according to the Ministry’s instructions, only one specialist’s opinion is required to determine such a threat – including that of a psychiatrist. A significant portion of the medical community opposed this approach.
