President of the Supreme Bar Council calls out Tusk. “It is the court, not politicians, who assess”

“A witness may appoint a legal representative. This is the decision and will of the witness. Unfortunately, a prosecutor may refuse to allow a representative to participate in the questioning, because that is what the current regulations provide. It is the court, not politicians, that assesses the credibility of witness testimony, and it is also the court that determines whether someone has committed a crime, not politicians,” commented on social media Przemysław Rosati, President of the Supreme Bar Council.

Dr Emil Jędrzejewski, former head of the Southern Hospital, gave a shocking interview yesterday in which the name of Dawid Kacprzyk was mentioned. Serious allegations were made against the young doctor without specialization and at the same time an activist of Civic Platform (KO) – cases of deaths in the emergency department he coordinated are to be investigated.

An inconvenient doctor for the authorities has already become a target. Donald Tusk publicly stated that the credibility of the whistleblower doctor from the Southern Hospital in Warsaw as a witness “appears to be questionable”, although procedures with the doctor and his legal representative are scheduled at the prosecutor’s office only for Monday.

Roman Giertych also joined the criticism, among others. Online, the actions of the prosecutor’s office against the doctor were also being criticized.

“Why did the prosecutor ask dozens of questions to Dr Emil Jędrzejewski in a situation where the witness clearly stated that he would give testimony in the presence of a legal representative?” asked attorney Dr Bartosz Lewandowski on social media.

According to the Analytical Collective “Res Futura”, the only window of opportunity for Civic Platform (KO) is to push a narrative about the “moral responsibility of the whistleblower”.

“In Polish legal regulations, a witness does not have a guaranteed right to a legal representative. Dr Emil Jędrzejewski was obliged to testify before the prosecutor’s office,” she stated.

The President of the Supreme Bar Council, Przemysław Rosati, responded to this comment.
