Supreme Court Ruling: Dariusz Barski Is the National Prosecutor, Adam Bodnar Faces Major Challenge

In a decisive ruling today, Poland’s Supreme Court (SN) clarified the ongoing dispute over the role of the National Prosecutor. The Court’s Criminal Division confirmed that Dariusz Barski is the legitimate National Prosecutor, debunking claims made by Justice Minister Adam Bodnar.

The case, initially raised by the Gdańsk District Court, questioned the legality of Barski’s return to active duty and his appointment as National Prosecutor. Despite attempts by the current prosecutor’s office to block the decision, including filing motions to exclude Supreme Court judges, the court ruled in Barski’s favor.

Commenting on the ruling, PiS MP and lawyer Marek Ast stated, “This is a significant blow to Minister Bodnar, whose actions we’ve long deemed illegal. Today’s ruling confirms that Barski’s appointment stands, and previous actions by the neo-Prosecutor Korneluk may now be legally challenged.”

This ruling poses a major legal and political issue for Bodnar, raising concerns over the legitimacy of ongoing prosecutions initiated by the neo-prosecutor’s office.
